Terms of Service

These Terms form a binding agreement between you and Renters Speak.org. By creating an account you electronically sign and agree to them. Please read them carefully.

Your electronic agreement.

When you check the box and click "Create account," you are signing this agreement electronically. That signature has the same legal effect as a handwritten one. If you do not agree, do not create an account.

1. Acceptance of These Terms

These Terms of Service ("Terms") form a legally binding agreement between you and Renters Speak.org ("Renters Speak," "we," "us," or "our") governing your access to and use of the Renters Speak.org website, mobile experience, and any related services (collectively, the "Service"). By creating an account, signing in, browsing reviews, posting any content, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy and Community Guidelines, which are incorporated by reference. If you do not agree to all of these Terms, you may not create an account, post content, or use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.

2. Eligibility & Your Account

You must be at least 18 years old and legally able to enter into contracts to create an account. You must provide accurate, current, and complete information at registration and keep it updated. You are solely responsible for safeguarding your password and for every action taken under your account, whether or not you authorized it. You agree to notify us immediately of any unauthorized use or security breach. You may not share, sell, transfer, or lend your account, and you may create only one account per person. Providing false contact information, impersonating another person, or registering on behalf of someone without their consent is strictly prohibited and may result in immediate termination and legal action.

3. Your Electronic Agreement (Signature)

By checking the agreement box at sign-up and clicking "Create account," you affirmatively consent to these Terms and acknowledge that this constitutes your electronic signature and legally binding electronic agreement under the U.S. Electronic Signatures in Global and National Commerce Act (E-SIGN Act, 15 U.S.C. § 7001 et seq.) and the Uniform Electronic Transactions Act (UETA). You agree that your electronic acceptance has the same legal force and effect as a handwritten signature. You further consent to receive related notices, disclosures, and records electronically. You may withdraw this consent only by closing your account, which terminates your right to use the Service.

4. Reviews Must Reflect Genuine Experience

Reviews are the core of Renters Speak. You agree that every review you post reflects your own honest, first-hand experience as a tenant (or, where applicable, a landlord responding to reviews about you) at the specific property and with the specific landlord named. You may not post a review about a rental you did not personally experience, post on someone else's behalf, copy another person's words, or use content generated by artificial intelligence to fabricate a rental experience. You must provide accurate landlord names and property addresses, rate fairly and proportionally to what actually happened, and update or remove a review if you later learn it was inaccurate. Posting a review you know to be false, misleading, or vindictive is a breach of these Terms.

5. Prohibited Conduct & Content

You will not post, upload, or transmit any content that: is false, fraudulent, defamatory, harassing, threatening, abusive, hateful, or discriminatory; contains another person's personal or identifying information (home address, phone, Social Security or ID numbers, financial details); constitutes hate speech, slurs, or attacks on protected groups; depicts or promotes violence, self-harm, or illegal acts; is sexually explicit; is advertising, spam, or a paid endorsement not disclosed; infringes another party's copyright, trademark, or other intellectual property; or attempts to manipulate ratings. You will not offer, accept, or solicit any payment, discount, favor, or benefit in exchange for writing, removing, or editing a review, and you will not retaliate against anyone for posting or participating in a review. You will not use bots, scrapers, or automated tools to access, collect, or redistribute Service data, or attempt to disrupt or overload the Service.

6. Content You Submit; License to Us

You retain ownership of the reviews and other content you submit, but you represent and warrant that you have all rights needed to post it and that it does not violate these Terms or any third party's rights. By submitting content, you grant Renters Speak a worldwide, perpetual, irrevocable, royalty-free, sublicensable, and transferable license to host, store, use, copy, reproduce, adapt, edit, display, publish, distribute, and otherwise exploit that content in connection with operating, promoting, and improving the Service. You also grant other users a limited license to view your content on the Service. You are solely responsible for your content and any consequences of posting it.

7. Content Moderation & Removal

We are not a publisher of user content and do not endorse or verify any review, but we reserve the right (without obligation) to review, screen, edit, hide, or remove any content that we believe violates these Terms, our Community Guidelines, or applicable law, or that we determine is harmful, objectionable, or inaccurate. We may also remove content in response to valid legal requests or landlord disputes. Reviews may be flagged by the community; flagged content is reviewed and may be removed or restored at our discretion. We may suspend, restrict, or terminate any account, without notice, for conduct we believe violates these Terms or harms the Service or others.

8. Membership & Payments

Reading reviews and browsing the directory requires a membership. Membership is sold as a one-time purchase of 30 days of access for $9.99 ("Access Period"). There is no automatic renewal and no recurring billing — you must manually purchase another 30 days when your access expires. Writing reviews, creating a profile, and responding to reviews (for verified landlords) is always free. All payments are processed by our payment provider (Stripe); we do not store your full card details. Unless required by law, payments are non-refundable, and partial refunds for unused days are not provided. We may change pricing upon reasonable notice; changes affect only future purchases. Membership is personal and non-transferable. Disputing a valid charge without good faith basis ("friendly fraud") may result in account termination.

9. No Professional Advice; Not Verified Facts

Reviews represent the personal opinions of the individuals who wrote them and are not statements of fact verified by Renters Speak. We do not investigate, endorse, or guarantee the accuracy, completeness, or truthfulness of any review, rating, or landlord profile. Nothing on the Service constitutes legal, financial, real estate, or professional advice. You should not rely solely on reviews when making housing decisions and should independently verify information. Your use of the Service and any decision based on its content is entirely at your own risk.

10. Your Indemnity

You agree to indemnify, defend, and hold harmless Renters Speak.org and its officers, directors, employees, volunteers, agents, and affiliates from and against any claims, damages, losses, liabilities, judgments, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: your content or reviews; your breach of these Terms; your violation of any law or the rights of any third party (including landlords named in your reviews); or your misuse of the Service. We reserve the right, at our own expense, to assume the exclusive defense of any matter subject to indemnification, in which case you will cooperate with us.

11. Disclaimers & Limitation of Liability

The Service is provided "AS IS" and "AS AVAILABLE," with all faults and without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant the Service will be uninterrupted, secure, or error-free. To the maximum extent permitted by law, in no event will Renters Speak be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from the Service is limited to the amount you paid us in the 12 months preceding the claim, or $10.00, whichever is greater.

12. Dispute Resolution & Arbitration; Class Waiver

Except for small-claims court matters, any dispute or claim arising out of or relating to these Terms or the Service will be resolved by final and binding arbitration in the State of Arizona, under the American Arbitration Association rules, rather than in court. You and Renters Speak each waive any right to a jury trial and to participate in a class action, class arbitration, or representative proceeding; any dispute will be arbitrated on an individual basis only. Before arbitrating, you agree to first contact us in writing and attempt informal resolution for at least 30 days. This section survives termination of these Terms. You may opt out of arbitration by sending written notice to us within 30 days of accepting these Terms.

13. Account Termination

You may close your account at any time from your Profile page. We may suspend or terminate your account and access to the Service, and remove any content, immediately and without notice if we believe you have violated these Terms, harmed other users or the Service, or acted unlawfully. Upon termination, all licenses granted by you remain in effect for content already published, and the surviving provisions of these Terms continue to apply.

14. Intellectual Property

Except for content you submit, the Service — including the Renters Speak.org name, logo, design, text, graphics, software, and code — is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Service, or use our trademarks, without our prior written consent. Reviews and landlord profiles may not be scraped, aggregated, or republished in bulk without express written permission.

15. Changes to These Terms

We may update these Terms from time to time. We will post the revised Terms with an updated "Last updated" date and, for material changes, notify registered users by email or in-app notice. Your continued use of the Service after the effective date of any change constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service and close your account. The version of these Terms you accepted at registration, together with any later versions you accept by continued use, governs your use.

16. General Provisions

These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-laws principles. If any provision is found unenforceable, the remainder remains in full force. These Terms, together with the Privacy Policy and Community Guidelines, are the entire agreement between you and Renters Speak regarding the Service, and supersede all prior agreements. Our failure to enforce any right is not a waiver. You may not assign these Terms without our consent; we may assign them freely. Section titles are for convenience only.
